“The Great Divide: Addressing the Gap Between Counselors’ Understanding and Application of Regulatory Issues”

Healthcare is one of the most regulated industries in the United States and encompasses the counseling profession. Counselors are trained very well to be counselors, but not very well to be regulatory and compliance persons. However, this creates a gap between what counselors are expected to know in a highly regulated industry and our ability to interpret changing laws, rules, and policies for practice. Our natural human extinct is to lean heavily on those who “know better”, perpetuating sometimes inaccurate information for unsuspecting counselors. This presentation aims to help bridge the gap between amazing counselors and their ability to adequately understand and interpret ever-changing regulations.

Objectives:

• Identify the hierarchy of regulating bodies governing the counseling profession as it relates to prioritization of concerns.
• Connect existing regulations (e.g., laws, rules, policies) with at least 2 common regulatory concerns in practice.
• Identify at least 2 ways to manage gaps with changing regulatory concerns.

My name is Jenny L. French. I am currently licensed as an LPC/MHSP in Tennessee. I graduated with my Master’s in Clinical Mental Health Counseling from Freed-Hardeman University in December 2019 and began working in a group practice in 2020. In the summer of 2023 I opened my own solo practice. I have been a regional representative for the West Central TN region since 2020. I have provided continuing education on various regulatory topics including HIPAA compliance with minors and ethical and legal implications regarding use of professional titles. This summer I plan to present at the TLPCA summit on scope of practice concerns regarding counselors in Tennessee.
